The fight against undeclared work

In order to combat undeclared work, Articles L 8222-1 et seq of the French Labour Code require that the principal must ensure, during the conclusion of a contract for the provision of a service for an amount at least equal to €3,000 tax inclusive, whether he/she is the client or the service provider, that his/her co-contracting party is in order both in terms of registration (RCS, trade directory, professional order or official authorisation) and social and fiscal declarations. If not, the principal will be complicit in the offences committed by the service provider and ordered to pay, along with the service provider, the corresponding fines.

The Law of 13 August 2004 requires that this obligation to verify should be repeated every six months until the end of the execution of the contract (amended Article L 8222-1 of the Labour Code).

Decree n° 2005-1334 of 27 October 2005 stipulates the extent of the principal’s obligations, the entire provisions being codified in Articles R 8222-1 et seq of the Labour Code.
